Commercial Litigation and Dispute Resolution

The attorneys at The Dushkin Law Firm provide legal representation in all types of business disputes and commercial litigation.  Our practice includes simple and complex debt collection; actions involving creditor’s rights; all types of contract disputes; lawsuits involving fraud, other business torts and the Texas Deceptive Trade Practices Act; fraudulent transfer actions (also known as voidable transfer actions); employment disputes (including covenants not to compete and other restrictive covenants); theft or misappropriation of trade secrets litigation; real estate disputes, including partition suits; construction suits; landlord-tenant disputes; lender liability suits; insurance disputes; actions involving partnership/shareholder/ownership disputes; injunctions; corporate and shareholder actions; and trust disputes.

Although each case is unique, in most disputes, there will be several options for resolution, including negotiation and mediation, in addition to arbitration or litigation.  Our attorneys will work with our clients to review and explain available options to them and to develop a practical, cost-effective action plan that is customized to our client’s needs and the unique facts of each case.

Lawsuits and arbitration proceedings are often expensive and disruptive of business operations.  Fortunately, there are usually opportunities during the course of such proceedings to resolve the dispute before incurring the full expense and inconvenience of a trial or arbitration hearing.  When the parties’ own negotiations reach an impasse, non-binding mediation of a dispute can be a very effective tool for resolving disputes.   In non-binding mediation, an impartial third party (often an attorney of many years’ experience or an ex-judge, and in all events, certified or qualified to perform mediation) is paid to facilitate settlement negotiations between the parties.

Although a negotiated or mediated settlement of a business dispute is often the wisest course to take, there are always exceptions.  On occasion, litigating a case to judgment is the best way to resolve a dispute, and the attorneys at The Dushkin Law Firm can provide strong advocacy for our clients in litigation or arbitration.

Our attorneys always strive to give our clients honest representation.  This includes giving clients our candid assessment of the strength and weaknesses of their positions and options.  We will always tell our clients the truth — what we think they need to know to make cost-effective business decisions — even when it may not be what they want to hear.
